These terms apply to your use of equestriandestinations.com (the “Site”) and any related services we provide. Please read them carefully. By using the Site, submitting an inquiry, or contacting us, you accept these terms. If you do not agree with them, please do not use the Site.
1. Who we are
The Site is operated by Equestrian Destinations (“we”, “us” or “our”). You can reach us using the contact details on the Site.
In these terms:
- “you” or “rider” means anyone who uses the Site or contacts us.
- “Operator” means any independent third party that owns, runs, supplies, or markets a horseback riding holiday, trip, tour, lesson, activity, accommodation, transport, or other experience featured on or accessed through the Site. This includes resorts, ranches, stables, riding centers, lodges, tour operators, and travel providers.
- “Content” means all text, images, descriptions, listings, and other material on the Site.
2. What we do, and what we do not do
Equestrian Destinations is a curated discovery and concierge platform. We showcase horseback riding holidays and equestrian travel experiences from around the world and help riders find and connect with the Operators who provide them.
To be clear about our role:
- We are not a tour operator, travel agent, booking company, or travel company. We do not hold any travel license and do not present ourselves as a seller of travel.
- We do not sell, organize, operate, supply, or control any holiday, trip, tour, lesson, activity, accommodation, transport, or equestrian experience.
- We do not take bookings or take payment for any holiday or activity. We do not charge you a booking fee, and we take no commission on your booking. Operators keep 100% of what you pay them.
- Every holiday or activity is provided by an independent Operator. Any contract for a holiday or activity is made directly and solely between you and the Operator. We are not a party to that contract and have no responsibility or liability under it.
We act only as an introducer and a source of information.
3. Inquiries and introductions
When you submit an inquiry, complete a contact form, or ask us to help you plan, we may pass your details to one or more relevant Operators, or otherwise introduce you, so that they can respond to you directly.
Once an introduction is made:
- Any further communication, proposal, quote, booking, contract, and payment is directly between you and the Operator.
- We do not guarantee that any Operator will respond, will have availability, or will offer any particular itinerary, inclusion, or price.
- We are not involved in those dealings and are not responsible for them.
4. Information on the Site
Much of the information about destinations and Operators is supplied to us by Operators or compiled editorially. We take reasonable care in presenting it, but:
- We do not warrant that any Content is accurate, complete, current, or free from error.
- Prices, availability, itineraries, inclusions, dates, and conditions are set by Operators and can change at any time without notice.
- Photography and descriptions are illustrative and may not reflect the exact experience you receive.
You should always confirm all details directly with the Operator before you book and before you travel.
5. The Operator’s own terms apply to your trip
When you book with an Operator, that Operator’s own terms apply. They cover its pricing, payment, deposit, cancellation, refund, insurance, liability, and safety policies, and any rules it sets for taking part.
You are responsible for reading and understanding the Operator’s terms before you book. We are not responsible for those terms, for their fairness, or for enforcing them, and we cannot resolve disputes between you and an Operator.
6. Equestrian activities carry inherent risk
Horse riding and equestrian activities are inherently dangerous and can result in serious injury or death, regardless of a rider’s experience or skill. These risks exist even when reasonable care is taken.
Risks include, but are not limited to, falls; being kicked, bitten, thrown, stepped on, or trampled; the unpredictable nature and behavior of horses; difficult, remote, or unfamiliar terrain; weather; and the condition of tack, equipment, and facilities.
By using the Site, and by taking part in any equestrian activity arranged through an Operator you found via the Site, you acknowledge and accept that:
- You take part entirely at your own risk.
- We do not inspect, assess, certify, supervise, train, or guarantee the safety, suitability, qualifications, standards, insurance, or conduct of any Operator, guide, instructor, horse, item of equipment, facility, or activity.
- You are responsible for satisfying yourself that an Operator, location, and activity are appropriate and safe for you before you take part.
- You are responsible for honestly assessing and disclosing to the Operator your riding ability, experience, fitness, health, and weight, and any condition that could affect your safe participation, and for following the Operator’s instructions and wearing appropriate safety equipment, including a helmet.
7. Health, fitness, and suitability
You are responsible for ensuring that you are medically and physically fit to take part in any equestrian activity. Operators often set their own age limits, weight limits, fitness levels, and experience requirements, and these vary widely between experiences. If you have any doubt about your fitness to ride or travel, consult a doctor before booking.
8. Insurance
We strongly recommend that you take out comprehensive travel insurance for every trip, and that the policy specifically covers horse riding and equestrian activities. Many standard travel policies exclude horse riding altogether or cover it only as a paid add-on, so check the wording carefully.
Your cover should also extend to medical treatment, emergency repatriation, and cancellation. We do not provide insurance, and we are not responsible for any loss you suffer because you traveled without adequate cover.
9. Affiliate links and third-party links
The Site may contain affiliate links. If you click such a link and go on to make a purchase, we may receive a commission from the third party at no additional cost to you.
The Site also links to Operator websites and other third-party sites that we do not own or control. We are not responsible for the content, products, services, accuracy, or practices of any third-party site, and a link does not mean we endorse it.
10. Intellectual property
The Content on the Site, including its text, design, layout, logos, and branding, is owned by us or our licensors and is protected by intellectual property laws. Photography and descriptive material supplied by Operators or photographers remain the property of their respective owners.
You may view and use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, republish, distribute, scrape, or otherwise exploit any Content without our prior written permission or the permission of the relevant owner.
11. Your use of the Site
You agree to use the Site lawfully and not to:
- Submit any information that is false, misleading, unlawful, infringing, or harmful.
- Misuse the Site, attempt to gain unauthorized access to it, or interfere with its operation or security.
- Use automated means to extract or copy Content.
If you submit any material to us, such as an inquiry, a review, or a photograph, you confirm that you have the right to do so, and you grant us a non-exclusive, royalty-free license to use that material in connection with operating and promoting the Site. You remain responsible for anything you submit.
12. Privacy and data protection
We process personal data in accordance with our Privacy Policy, which forms part of these terms.
In particular, when you make an inquiry, we may share the details you provide with one or more Operators so that they can respond to you directly. Our Privacy Policy explains what data we collect, how we use it, who we share it with, and your rights.
13. Our liability
Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law. This includes liability for death or personal injury caused by our own negligence, and liability for fraud or fraudulent misrepresentation.
Subject to that, and to the fullest extent permitted by law:
- We are not liable for the acts, omissions, conduct, standards, safety, or performance of any Operator or other third party.
- We are not liable for any injury, death, loss, damage, cost, or expense arising out of or in connection with any holiday, trip, activity, or Operator that you find, contact, or book through the Site.
- We are not liable for any loss arising from inaccurate or incomplete information, from unavailability, or from the cancellation, change, or withdrawal of any Operator’s offering.
- We are not liable for any indirect or consequential loss, or for any loss of profit, opportunity, or enjoyment.
- We provide the Site to you free of charge and receive no payment from you. If we are found liable to you despite the above, our total liability for any matter connected with the Site will not exceed the amount, if any, that you have paid us.
14. Indemnity
You agree to indemnify us and hold us harmless against any claim, loss, damage, cost, or expense (including reasonable legal costs) arising out of your breach of these terms, your misuse of the Site, or any dispute between you and an Operator.
15. Changes to these terms
We may update these terms from time to time. The version published on the Site at the time you use it is the version that applies. Please check this page periodically so that you are aware of any changes.
16. If part of these terms cannot be enforced
If any provision of these terms is found to be invalid or unenforceable, the rest of the terms remain in full force and effect.
17. Governing law and jurisdiction
These terms, and any dispute arising out of or in connection with them or your use of the Site, are governed by the laws of the District of Columbia, United States, without regard to its conflict of laws rules, and are subject to the exclusive jurisdiction of the courts located in the District of Columbia.
